Terms and Conditions for Video Submission and Review Services

 

1. Introduction Welcome to TrainWithKayla, operated by Kayla Bushey Consulting LLC. These Terms and Conditions govern your submission of personal athletic performance videos via TikTok, Instagram, or other approved platforms for the purpose of receiving technical form coaching and/or drills and strength training recommendations.

2. Services Offered

• Single Video Review: You may submit one video per purchase to receive a detailed technical form review, which will be provided via email.

• Additional Training Services: Optionally, you can purchase drills and strength training services tailored to the needs identified in your video review.

 

3. Video Submission Guidelines

• Videos must be clear and sufficiently detailed to allow for accurate analysis.

• Ensure that the video focuses on the specific skills or drills relevant to the services purchased.

• Submit your video as per the instructions provided at the time of purchase on the TrainWithKayla platform.

 

4. Use of Submitted Videos By submitting your video, you grant Kayla Bushey Consulting LLC and its associated social media accounts, including but not limited to Killabushey Instagram, unrestricted rights to use your video. This includes, but is not limited to, promotional purposes, instructional content, and other marketing activities.

 

5. Intellectual Property You affirm that you own or have the necessary licenses, rights, consents, and permissions to use and authorize Kayla Bushey Consulting LLC to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all submitted videos.

 

6. Privacy Your personal information will be handled in accordance with our Privacy Policy. We will not disclose your personal information to third parties except as explicitly provided in these Terms and Conditions.

 

7. Disclaimer of Warranties You agree that your use of our services is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. Kayla Bushey Consulting LLC expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability Kayla Bushey Consulting LLC will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the service.

 

9. General Conditions We reserve the right to modify or terminate the service for any reason, without notice at any time. We also reserve the right to alter these Terms and Conditions at any time.
